The VEOHRC has statutory responsibilities under the Equal Opportunity Act 2010 and Racial and Religious Tolerance Act 2001, as well as specific functions under the Charter of Human Rights and Responsibilities Act 2006. The VEOHRC's role encompasses the protection and promotion of human rights in Victoria, and preventing discrimination and vilification, through education, complaints resolution and engagement with communities, employers, government, and the public.
The VEOHRC is also proposed to be given new education, complaints handling and investigation functions under the Change or Suppression (Conversion) Practices Prohibition Bill 2020, which is currently before the Victorian Parliament.

The Commissioner role is a full-time statutory position, appointed by and responsible to the Board of VEOHRC for control of the day-to-day administration of the affairs of the VEOHRC in accordance with the policies, priorities and strategies determined by the Board of VEOHRC and exercising any other delegated functions, powers and duties.
