The Mental Health Tribunal (MHT) is an independent statutory tribunal established under the Mental Health Act 2014 (the Act). The Tribunal is an essential safeguard under the Act to protect the rights and dignity of people with severe mental illness who are receiving compulsory treatment. The primary function of the Tribunal is to determine whether the criteria for compulsory mental health treatment, as set out in the Act, apply to a person. If all criteria apply to an individual person then the Tribunal makes a Treatment Order specifically for that person.

The Tribunal receives funding and administrative support from the Department of Health (DH). Staff are DH employees who report directly or indirectly to President of the Tribunal. The Tribunal consists of an administrative arm, staffed by VPS employees, and Tribunal members, who are governor-in-council appointees.

The Tribunal’s vision is to promote rights by ensuring the participation of people with mental illness and their carers in decision making. If you believe you can make a contribution in this regard, then we encourage you to join us.

The MHT promotes diversity and equal opportunity in employment and is committed to a more diverse workforce. If you are an Aboriginal or Torres Strait Islander applicant, or if you have a disability, and require advice and support with the recruitment process, contact our Diversity Unit on DiversityInclusion@dhhs.vic.gov.au.
