The Office of Public Prosecutions (OPP) is an independent statutory authority responsible for preparing and conducting criminal prosecutions in Victoria on behalf of the Director of Public Prosecutions (DPP). Matters prosecuted by the DPP and the OPP involve serious crimes or matters that are of significance to the fair and effective operation of the Victorian criminal justice system. The OPP consists of the Solicitor for Public Prosecutions and a staff of approximately 400 providing legal and corporate support to the DPP, the Chief Crown Prosecutor and Crown Prosecutors in the exercise of their independent roles in the criminal justice system.

Principal Solicitor (VPS 6) – (Full Time, Ongoing)

The Office of Public Prosecutions (OPP) has an opportunity for an experienced Solicitor to join our organisation as a Principal Solicitor within our Proceeds of Crime division.

This position is located within the Proceeds of Crime Directorate of the OPP which has primary responsibility for the preparation and conduct of the most complex confiscation trials and litigation in both the County and Supreme Courts and the appellate jurisdiction.

At this level the incumbent is expected to identify and respond to new and emerging legal issues. The incumbent may be required to make decisions where there is limited precedent, and use creativity in applying appropriate legal concepts to situations.

Flexible working arrangements will be considered.

About the Role:

  • Prepare the most complex confiscation matters, including Civil Forfeiture and Unexplained Wealth applications, and appear in the County and Supreme Courts when required;
  • Advise Management on issues arising from confiscation litigation, resources, points of law, emerging legal and policy issues, and provide detailed reports/memoranda of advice as requested;
  • Provide mentoring and guidance to all staff as required.

As our ideal candidate you will have:

  • A thorough working knowledge of confiscation law (or a demonstrated ability to gain that quickly), some working knowledge of the criminal law and its processes, and considerable experience in confiscation practice or commercial litigation. 
  • Demonstrated extensive experience in the preparation of highly complex confiscation cases or commercial/civil cases for trial, and experience with the interpretation and application of relevant statutes. 
  • Excellent verbal and written communication skills, with the ability to provide clear, accurate and concise advice to senior management/stakeholders.
