About the role

We have an exciting opportunity for an experienced lawyer to join the Native Title Team at a time of historic change in the relationship between First Peoples and the State.

The VGSO is the exclusive provider of native title services to government clients. The Native Title Team sits within the Commercial, Property & Technology Branch and works closely with the Public Law & Planning Branch on matters relevant to human rights, public land management and cultural heritage protection. This role would ideally suit a mid-level practitioner wanting to develop a joint public law/native title practice.

The primary objectives of this role will be to:

  • Advise clients from across the public sector on Traditional Owner rights and government decision making in the areas of native title, cultural heritage and human rights.
  • Advise clients from across the public sector on compliance with settlement agreements and relevant legislation including:
    • Native Title Act 1993 (Cth)
    • Traditional Owner Settlement Act 2010 (Vic)
    • Aboriginal Heritage Act 2006 (Vic)
    • Charter of Human Rights and Responsibilities Act 2006 (Vic)
    • Advancing the Treaty Process with Aboriginal Victorians Act 2018 (Vic)
  • Appear on behalf of the State in native title claims listed in the Federal Court and matters listed in the National Native Title Tribunal and participate in related mediations and case management hearings
  • Draft court documents and settlement agreements, including Indigenous Land Use Agreements pursuant to the Native Title Act 1993 (Cth)
  • Work closely with the PuLP Branch on Supreme Court litigation regarding Traditional Owner rights and government decision making
  • Undertake statutory interpretation and review administrative decision making
  • Assist with legislative development

About the successful candidate

  • Specialist knowledge and demonstrated experience in the principles and practice of native title and/or administrative law
  • Strong understanding of, and experience in, statutory interpretation
  • The ability to conduct complex and sensitive proceedings in state and federal courts/tribunals
  • Significant experience providing authoritative written and oral advice which is fit for purpose
  • Excellent interpersonal, communication and client relationship management skills
